Oystermen

The variety of bed closures that oystermen have had to keep track of and, subsequently, limit their harvest because of is an unfortunate consequence of the BP oil spill. With both federal and state governments monitoring the water and determining where oyster collection can take place, oystermen have been particularly hampered. While these closures have taken place to maintain the quality and safety of the oysters on the market, it has put a severe damper on the wallet of those fishermen that depend on the delicious seafood for their business and day-to-day income.

Just like other fishermen, oystermen have the right to make a claim for lost wages and other business expenses incurred as a result of the BP oil spill. Utilizing a variety of financial documentation the client makes available, our firm will aggressively pursue the just and fair compensation our clients deserve as a result of these closures. Subsequent damage that the oil may cause in the oyster beds, thereby harming the profit margin of future seasons, remains unclear but will be a definite item under which our firm will pursue compensation.

The claims process can be tricky and at times, especially in the fishing industry, receipts are not available due to the tendencies for cash transactions. However, there is a variety of ways in which one of our attorneys may prove the expected earnings of an oystermen left out of work by the BP oil spill. What's more, it is important that, given the possibility or likelihood of ongoing damage being caused to the oyster beds by the oil leak, an attorney survey any paperwork BP offers fishermen. Signing and accepting a claim that does not take into account future damage would be a reckless act that some might not realize they are even doing.

Louisiana is world famous for its oysters and it is tragic that the BP oil spill has put this important industry in danger. Those fishermen who harvest oysters from the Gulf have had a stressful time wondering just when they might be able to return to "business as usual." The fact remains, though, that this might not be possible for quite some time. Until then, it is important that oystermen and other fishermen hire an attorney who will look out for their interests and begin a claim process that, whether out of court or through a settlement/judgment, gets these people the money they deserve.
