Louisiana Valued Policy Law- La. R.S. 22:695
Did your home get totaled because of wind damage or flood damage from Hurricane Katrina? You may be entitled to 100% of the full value of your Homeowners Insurance Policy under Louisiana’s Valued Policy Law.
According to Louisiana's Valued Policy Law. La. R.S. 22:695, an insurer has to pay the complete value of a loss without offset or deduction in the event that a valuation was put on the property and used to figure out the premiums.
If, however, the insurer clearly noted in the policy that a different approach would be used to calculate the loss, then it might not be obligated to compensate you for the loss’s full value.
